For building owners: seek advice while structural drawings are being finalised. Starting notifiable work before the statutory procedure is complete can cause delay, extra expense and possible court action. The Act has no retrospective notice process, so a notice served after work has begun does not correct the earlier failure.
For adjoining owners: receiving a notice does not mean you must object to the project. You may consent, consent after practical points have been clarified, or appoint a surveyor where a dispute has arisen. A Schedule of Condition provides a dated written and photographic record of accessible parts of the neighbouring property before work begins. If surveyors are appointed, the Award may cover construction methods, protection, access, working hours and procedures for relevant damage. It does not grant planning permission, determine every boundary dispute or replace other approvals.
