Party Wall Surveyor in Islington

Party wall advice for Islington owners

Harding Chartered Surveyors advises building owners and adjoining owners on Party Wall etc. Act 1996 matters throughout Islington, including Angel, Barnsbury, Canonbury, Clerkenwell, Finsbury, Highbury, Holloway and Pentonville. We review proposed work, identify the owners who may need notice and explain whether the matter can proceed by written consent or requires a surveyor appointment.

Islington contains Georgian and Victorian terraces, converted houses, mansion blocks, estates, commercial premises and newer apartment developments. Ownership can therefore be more complicated than the two immediately adjoining occupiers. Freeholders, qualifying leaseholders and management companies may all need to be identified before notices are served.

When the Party Wall etc. Act 1996 may apply

The Act covers defined categories of work rather than every alteration. It may apply to:

  • building a new wall on or up to the line of junction between separate properties;
  • work to an existing party wall or party structure, including cutting in steel beams, raising or thickening a wall, underpinning or removing a chimney breast where the statutory right applies; and
  • excavation within three metres, or in some cases six metres, where the proposed foundations meet the depth and geometry tests in section 6.

Common Islington projects that need review include rear and side-return extensions, loft conversions with steelwork bearing into a shared wall, basement excavation, underpinning, rebuilding at a boundary and deeper foundations close to a neighbouring building. Routine decoration and light internal work are not automatically covered; the design and construction method determine whether notice is required.

A party structure can also be a floor or other partition separating separately owned flats. Because an “owner” under the Act can include a leaseholder with an interest exceeding one year, work in a converted house or block may require notices to more than one adjoining owner.

Notice periods and responses

Work to an existing party structure normally requires at least two months’ notice. A new wall at the line of junction and qualifying excavation normally require at least one month. An adjoining owner can agree to an earlier start, but that agreement should be recorded rather than assumed.

For party-structure and excavation notices, no written consent within 14 days normally means a dispute is deemed to have arisen. The owners may then appoint one agreed surveyor or each appoint a surveyor. The section 1 procedure for a new boundary wall differs, so using the correct statutory route matters. A notice will normally cease to have effect if the relevant work has not begun within twelve months.

Planning permission, Building Regulations approval, listed-building consent, conservation-area controls and permissions required under a lease are separate from the Party Wall Act. Islington has 42 conservation areas, but obtaining planning or heritage consent does not remove the need to comply with the Act where it applies.

For an official overview, read the GOV.UK explanatory booklet and the RICS consumer guide.

Older Islington terraces and converted houses can show historic cracking, altered chimney breasts, previous extensions and changes of level. A condition record should describe existing defects carefully so that pre-existing movement is not confused with damage from the proposed work. In flats and mixed-use buildings, title and lease information may identify several adjoining owners or management requirements.

How the process works

  1. Initial review: we examine the drawings, ownership information and proposed programme to identify which parts of the Act may apply.
  2. Notices: the correct notices and supporting information are prepared and served on the relevant adjoining owners.

Who normally pays?
Where the building owner's work creates the need for the procedure, the building owner will usually pay the reasonable costs of the adjoining owner's surveyor. There can be exceptions, including costs arising from work requested solely for the adjoining owner's benefit. We provide a written scope and fee proposal after reviewing the project. See our guide to party wall surveyor costs.

Advice for Islington building owners

Before serving a Party Wall notice, we check the proposed design, foundation information, ownership and intended start date. Serving notice on the wrong person, under the wrong section or without the drawings required for excavation can create avoidable delay.

If written consent is not received and a statutory dispute arises, the appointed surveyor does not become the building owner's advocate. The surveyor must act impartially under the Act. We request the technical information needed and coordinate with the designer or structural engineer so any Award addresses the notifiable work clearly.

Early discussion with neighbours is sensible, but informal agreement is not a substitute for the written notice and response required by the Act. Where consent is given, the parties may still choose to record the adjoining property's condition before work begins.

Advice for adjoining owners

If you have received a notice, check that it identifies the correct owners and properties, describes the work accurately and includes the drawings required for an excavation notice. You can consent, agree to use one surveyor or appoint your own surveyor. Our adjoining-owner guide explains the options.

Consent does not remove the building owner's responsibility for damage caused by the notifiable work, although it normally means an Award is not prepared. An adjoining owner does not have to appoint a separate surveyor: both owners may appoint one agreed surveyor, provided that person accepts the appointment and acts impartially.

Schedules of condition and Awards

A schedule of condition is a dated written and photographic record of the neighbouring property before work starts. It is not always legally required, but it can provide useful evidence if damage is alleged later.

Where a dispute arises, the appointed surveyor or surveyors settle relevant matters in a Party Wall Award. An Award can set out the permitted work, access arrangements, safeguards, working hours and procedures for dealing with damage. It does not grant planning permission, determine the legal boundary or decide rights outside the Act.

Islington party wall process, costs and FAQs

After the notices are served

  1. Response: an adjoining owner may consent, concur in appointing one agreed surveyor or appoint a separate surveyor.
  2. Inspection and information: where appropriate, a schedule of condition is prepared and the surveyor reviews structural details, access and construction safeguards.
  3. Award: if a dispute has arisen, the surveyor or surveyors settle the matters within their statutory jurisdiction and serve the Award before the notifiable work proceeds.

Starting early reduces the risk that notice periods or missing technical information delay the planned start. For excavation, structural drawings and foundation details are normally needed before the surveyors can complete their review.

Party wall surveyor fees in Islington

Fees depend on the work and the statutory procedure, not simply the postcode. Relevant factors include the number of owners and notices, the complexity of the design, whether one agreed surveyor or two surveyors are appointed, the need for inspections and the time required to agree an Award.

Islington party wall FAQs

Do I always need to appoint a surveyor?
No. If a valid notice is served and the adjoining owner consents in writing, the statutory surveyor procedure is not triggered. The owners can still choose to record the adjoining property's condition.

How much notice must be given?
Normally two months for work to an existing party structure and one month for a new wall at the line of junction or qualifying excavation. An adjoining owner can agree in writing to an earlier start.

What happens if an adjoining owner does not reply?
For party-structure and excavation notices, no written consent within 14 days normally creates a deemed dispute. The building owner must then follow the appointment procedure in the Act; silence is not consent.

Can a Party Wall Award stop the project?
An Award regulates work falling within the Act. It cannot decide planning merits or wider property rights, but it may require reasonable safeguards and working arrangements to protect the adjoining property.

What should I send for an initial review?
Send the site address, drawings, structural or foundation details if available, your intended start date and any notice you have received. We can then identify the likely statutory route and provide a clear quotation.

I contacted Handing Chartered Surveyors to undertake a Level 2 RICS survey for a help to buy redemption in Southall, following issues with the paperwork produced by a large online competitor, resulting in the original valuation document being rejected. On contacting Harding I set out my needs along with the issues faced previously, and Harding were very quick to respond, as well as to confirm they were happy to be flexible if there were issues with the process after the valuation report was produced. Jessica from the team visited and undertook the survey following a discussion about my specific situation and needs, as well as discussing the process and next steps. She was kind, courteous and communicative throughout, calling to discuss the valuation prior to it being finalised and issued. Help to Buy subsequently accepted the valuation with no issues at all, a success! While it is sometimes cheaper and quicker to go with a large provider, it is also very difficult to discuss case specifics, and to address any challenges. I am personally very grateful for the service I received, a strong reminder to go local to get what you need, and I will very happily employ Harding again for any future survey needs.
