Party Wall Surveyor in South London

Local Party Wall Surveyors in South London

Harding Chartered Surveyors advises building owners and adjoining owners across South London, including Clapham, Brixton, Balham, Tooting, Streatham, Camberwell, Dulwich and neighbouring districts. The area combines Victorian and Edwardian terraces, converted houses, mansion flats, post-war estates and newer apartment schemes, so ownership and construction must be checked for each project.

Party wall requirements should be considered while drawings are being developed, not after a contractor is ready to start. The statutory tests concern the proposed work, the boundary and neighbouring foundation levels. A project does not become notifiable merely because it is called an extension or loft conversion.

Work covered by the Party Wall etc. Act 1996

The Party Wall etc. Act 1996 principally covers work to an existing party wall or party structure, construction of a new wall at or astride a boundary, and excavation within three or six metres where the statutory depth and angle tests are satisfied.

Typical South London enquiries involve inserting loft beams, removing chimney breasts, rear and side-return extensions, basement work, underpinning and new walls close to boundaries. In converted houses and flats, floors and ceilings can be party structures and more than one qualifying owner may need to be identified.

Notices and project timing

Work to an existing party structure normally requires two months’ notice. A new boundary wall and qualifying excavation normally require one month. For section 2 and section 6 notices, no written consent within 14 days generally creates a deemed dispute. Section 1 has a different consequence, so every notice must be matched to the correct part of the Act.

Planning permission and Building Regulations approval do not replace the Party Wall procedure. Owners should allow time for title checks, design review, service of valid notices and, where necessary, surveyor appointments before the notifiable work begins.

How we can assist

Owners may appoint one Agreed Surveyor or separate surveyors. An appointed surveyor acts impartially under the Act and determines statutory matters rather than acting as an advocate.

Advice for adjoining owners

Receiving a notice does not require an immediate objection or unconditional consent. Check the drawings, foundation details, access proposals and protective measures first. You may consent in writing, seek clarification or appoint a surveyor if a dispute has arisen under the Act.

A Schedule of Condition gives both owners a dated written and photographic record of accessible areas before work starts. If surveyors are appointed, the Award can regulate the method and timing of notifiable work, inspections, temporary protection, access and the process for dealing with relevant damage.

South London property considerations

Terraced streets around Brixton, Clapham, Tooting and Streatham commonly generate loft and extension enquiries. Camberwell and Dulwich include terraces, villas, flats and larger period houses, while major routes and town centres contain mixed residential and commercial buildings. These variations can affect the party structures involved and the number of owners requiring notice.

Leasehold consent, planning conditions, access rights and boundary ownership are separate questions. A Party Wall Award cannot grant planning permission, determine every boundary dispute or replace a licence from a landlord. Our boundary surveying service may be appropriate where the boundary itself is disputed.

Fees and professional standards

Fees depend on the design, number of affected owners, quality of the drawings, access and whether an Award is needed. The building owner normally pays reasonable statutory costs, including reasonable adjoining-owner surveyor fees where an appointment is necessary, although allocation depends on the circumstances.

The Act does not require an appointed surveyor to hold a particular professional qualification. The government recommends selecting someone with suitable construction knowledge and experience of the legislation. Harding Chartered Surveyors is an RICS-regulated firm, and Jeremy Goldney reviews this guidance.

Independent guidance is available in the government explanatory booklet and the RICS consumer guide.

South London party wall FAQs

Does every rear extension require notice?
No. The wall position, excavation depth and neighbouring foundations determine whether the Act applies.

Can one surveyor act for both owners?
Yes. Both owners may appoint one Agreed Surveyor; otherwise each appoints a surveyor and the two select a third surveyor.

Can an adjoining owner stop lawful work?
The Act is not a veto. It provides a procedure and safeguards for notifiable work.

How early should advice be obtained?
Ideally while structural drawings are being prepared, so notices and the programme can be planned correctly.

I contacted Handing Chartered Surveyors to undertake a Level 2 RICS survey for a help to buy redemption in Southall, following issues with the paperwork produced by a large online competitor, resulting in the original valuation document being rejected. On contacting Harding I set out my needs along with the issues faced previously, and Harding were very quick to respond, as well as to confirm they were happy to be flexible if there were issues with the process after the valuation report was produced. Jessica from the team visited and undertook the survey following a discussion about my specific situation and needs, as well as discussing the process and next steps. She was kind, courteous and communicative throughout, calling to discuss the valuation prior to it being finalised and issued. Help to Buy subsequently accepted the valuation with no issues at all, a success! While it is sometimes cheaper and quicker to go with a large provider, it is also very difficult to discuss case specifics, and to address any challenges. I am personally very grateful for the service I received, a strong reminder to go local to get what you need, and I will very happily employ Harding again for any future survey needs.
