Party Wall Surveyor Holborn
Party wall advice for Holborn owners
Harding Chartered Surveyors advises building owners and adjoining owners on Party Wall etc. Act 1996 matters throughout Holborn and nearby Central London. We review proposed work, prepare and check notices, record schedules of condition and agree Party Wall Awards where a statutory dispute has arisen.
Holborn contains a dense mix of older terraces, mansion blocks, converted buildings, offices and mixed-use property. Projects around High Holborn, Red Lion Square, Lincoln's Inn Fields, Gray's Inn and the streets towards Bloomsbury and Clerkenwell can involve several adjoining interests, restricted access, basement structures and buildings under different freehold and leasehold ownership.
Party wall procedure is separate from planning permission, Building Regulations approval, listed-building consent and any licence required under a lease. We examine the drawings, foundation information and ownership before advising which neighbours require notice and what must happen before notifiable work starts.

When the Party Wall etc. Act 1996 may apply
The Act applies to defined categories of work rather than to every alteration. The principal categories are:
- building a wall on or up to the line of junction between separate properties;
- work to an existing party wall or party structure, including cutting in beams, raising or thickening a wall, underpinning, or removing projections where the statutory right applies; and
- excavating within three metres, or in some cases six metres, where the proposed excavation meets the depth and geometry tests in section 6.
In Holborn, notifiable work may arise during structural alterations to offices or flats, roof extensions where steelwork bears into a shared wall, basement excavation, underpinning, rebuilding at a boundary, or redevelopment close to neighbouring foundations. Routine internal decoration or light fixings are not automatically covered; the structure and method of work must be considered.
A party structure can include a floor or other partition separating flats or parts of buildings approached by separate entrances. Because the Act's definition of an owner can include qualifying leaseholders as well as freeholders, a single Central London project may require notices to more than one person or organisation.
For a general statutory overview, see the GOV.UK explanatory booklet and the RICS consumer guide.
Notice periods and responses
Work to an existing party structure normally requires at least two months' notice. A new wall at the line of junction and qualifying excavation normally require at least one month. The adjoining owner may agree to an earlier start where the Act permits, but that agreement should never be assumed.
For party-structure and excavation notices, the absence of written consent within 14 days normally means a dispute is deemed to have arisen. The owners may then appoint one agreed surveyor or each appoint a surveyor. The section 1 procedure for a new boundary wall differs, so a valid notice must identify the correct statutory route. A notice will normally cease to have effect if the relevant work has not begun within twelve months.
Advice for Holborn building owners
Before serving a Party Wall notice, we check the design, foundations, ownership and intended start date. Central London schemes can involve managing agents, commercial tenants, superior landlords or adjoining premises with limited inspection access, so early identification of every relevant owner is particularly important.
If a statutory dispute arises, an appointed surveyor does not act as the building owner's advocate. The surveyor must perform an impartial role under the Act, considering the rights and protections of both properties. We keep the procedure proportionate, request the technical information needed and coordinate with the project team while remaining within the surveyor's statutory jurisdiction.

Adjoining owners should assess the notice and supporting drawings before deciding how to respond. In a closely developed area such as Holborn, the effect of excavation, structural alteration, access and protection may depend on details that are not apparent from a short description of the project.
Advice for Holborn adjoining owners
Check that the notice identifies the correct owners and properties, describes the work accurately and includes the required plans where applicable. You may consent, concur in the appointment of one agreed surveyor, or appoint your own surveyor. Our adjoining-owner guide explains the options and the difference between consent and a statutory appointment.
Consent does not remove the building owner's responsibility for damage caused by the notifiable work, although it normally means that an Award is not prepared. An adjoining owner is not obliged to appoint a separate surveyor: one agreed surveyor can act for both owners provided both agree and the surveyor remains impartial.
Schedules of condition and Party Wall Awards
A schedule of condition provides a dated written and photographic record of the relevant parts of the adjoining property before work begins. It is common where damage could later be alleged, but is not a statutory requirement in every case. The inspection should concentrate on areas that could reasonably be affected.
Where a dispute arises, the appointed surveyor or surveyors settle matters within the Act in a Party Wall Award. Depending on the proposal, the Award may cover the manner and timing of work, protective measures, access, security arrangements and making good. It cannot grant planning permission, determine a boundary or decide rights outside the Act.
The building owner generally pays the adjoining owner's reasonable surveyor costs when the work is undertaken for the building owner's benefit. Costs are not automatic in every circumstance and may be allocated differently where work benefits both owners or unnecessary costs are incurred. See our party wall cost guide.
Holborn property and project considerations
Holborn's dense urban grain creates issues that are less common on suburban sites. A single building may contain flats, offices, retail premises and common parts controlled by a freeholder or management company. Notices may therefore need to be served on several qualifying owners, and inspection arrangements may involve occupiers who are not themselves the statutory adjoining owner.
Older masonry buildings and converted properties can contain pre-existing cracks, historic alterations and complex floor structures. Basement work and deep foundations can require close examination of structural drawings, temporary works and adjacent foundation levels. Roof extensions and internal reconfiguration may engage the Act where steelwork, bearings or other structural work affects a party wall or party structure.
Listed-building or conservation-area controls do not replace the Party Wall Act, and an Award does not authorise work for which separate consent is required. Likewise, a Party Wall Award cannot establish the legal boundary. If title or boundary position is disputed, consider our boundary survey service.
How the Holborn party wall process works
- Review the proposed drawings, foundation details, ownership and programme.
- Identify work within sections 1, 2 or 6 and every building or owner requiring notice.
- Serve the correct notices and record each adjoining owner's response.
- If a dispute arises, confirm appointments, inspect as appropriate and obtain the technical information needed.
- Agree and serve the Award before notifiable work begins, then remain available during the work.
Frequently asked questions
Does every Holborn refurbishment need a notice?
No. The Act applies to specified work at the boundary, to party walls or party structures, and to qualifying excavation. Cosmetic work and routine light fixings are not normally within the Act, but structural proposals should be reviewed against the statutory tests.
Can a neighbour stop the project?
The Act is not normally a veto over work that is otherwise lawful. If the owners disagree, the appointed surveyor or surveyors settle matters within the Act. Planning, access, covenants, rights of light, trespass and other legal rights remain separate.
Can one surveyor act for both owners?
Yes. The owners can appoint one agreed surveyor, who must act impartially. If they appoint separate surveyors, those surveyors also select a third surveyor who can be called upon if required.
How long does the process take?
There is no single timescale. It depends on the statutory notice period, the quality of the information, the number of owners, access and whether one or two surveyors are appointed. Central London ownership and management arrangements can add time, so early advice is sensible.
Who pays the surveyor fees?
The building owner usually pays reasonable costs arising from work carried out for that owner's benefit, but the Act allows costs to be allocated according to the circumstances and benefit of the work.
