The answer depends on the proposed structure, the boundary and neighbouring foundation depths—not simply whether the project is called an extension or loft conversion. When does the Party Wall Act apply?
The Party Wall etc. Act 1996 covers three broad categories of work:
- certain work directly to an existing party wall or party structure, such as inserting steel beams, raising a wall or removing a chimney breast;
- building a new wall at or astride the line of junction; and
- excavation within three or six metres of a neighbouring structure where the statutory depth test is met.
Not every extension, loft or excavation is notifiable. For example, the three-metre rule only applies if the proposed excavation goes below the level of the neighbour’s foundations. The six-metre test uses a 45-degree line measured from the bottom of those foundations. Structural drawings and reliable dimensions are therefore important.
Notices and the statutory timetable
A party-structure notice normally requires two months. Notices for a new wall at the boundary and qualifying excavation normally require one month. For section 2 and section 6 notices, no written consent within 14 days normally creates a deemed dispute, after which the surveyor appointment process can begin. Section 1 has different consequences, so a lack of reply should not be treated identically in every case.
A notice does not remain open indefinitely. Building owners should allow time to identify every adjoining owner, obtain the necessary design information and complete the statutory process before the contractor is due on site. Starting notifiable work too soon may expose the project to delay, additional cost and possible court action.

Guidance for adjoining owners
Receiving a notice does not mean that you must object to the project. You may consent, consent after practical points have been clarified, or appoint a surveyor where a dispute has arisen under the Act. Before responding, it is sensible to understand the drawings, excavation depth, proposed access, working methods and safeguards.
A Schedule of Condition records accessible parts of the adjoining property in writing and photographs before work begins. Where surveyors are appointed, an Award may deal with the method and timing of the notifiable work, protection, access, inspections and how relevant damage will be addressed.
The Award cannot grant planning permission, decide every boundary dispute or replace other consents. It determines matters within the Party Wall Act. Appointed surveyors also do not act as partisan representatives, regardless of which owner appointed them.

Can my neighbour stop lawful work?
