A Party Wall Notice formally notifies an adjoining owner of proposed work covered by the Party Wall etc. Act 1996. The right notice depends on the work: an alteration to a party structure, a new wall at the boundary or qualifying excavation nearby.

Harding Chartered Surveyors helps building owners prepare and serve notices and helps adjoining owners understand the documents they receive. We explain the relevant route before you commit to an instruction.

Start with the proposed work

When is a Party Wall Notice needed?

The Act applies in England and Wales. It can cover cutting into a party wall for a beam, raising or underpinning a party structure, building a new wall at the boundary, and excavation meeting the statutory distance and depth tests.

For excavation, distance is measured from the neighbouring building or structure, not simply the property boundary. The Section 6 guide explains the three-metre and six-metre tests.

Some minor work, such as fixing ordinary shelving or renewing plaster, may not require notice. The design and possible effect on the structure matter. Planning permission and building regulations are separate requirements; neither replaces the party wall procedure.

Three different routes

Which notice and notice period apply?

Proposed workNotice routeMinimum notice period
Work to an existing party wall or party structureParty structure notice, Section 3Two months
A new wall at or astride the boundaryLine of junction notice, Section 1One month
Excavation meeting the distance and depth testsAdjacent excavation notice, Section 6One month

One project may require more than one notice. A neighbour’s response within 14 days is a separate matter from the minimum notice period. An earlier start needs the appropriate agreement; consent should not be treated as automatic permission to start immediately.

See our notice-period guide for response deadlines and planning the sequence.

Prepare a clear notice

What information should a notice contain?

Requirements vary by notice type. The notice identifies the building owner, the proposed work and intended start date, with enough detail for the adjoining owner to understand the relevant work.

A Section 6 notice must include plans and sections showing the position and depth of the excavation and the location of any proposed building or structure. It must also state whether the building owner proposes to underpin, strengthen or safeguard the adjoining foundations. Special foundations proposed under a party structure notice also require specific information.

Send us the existing and proposed drawings, structural details, site address and any earlier notices or correspondence. A generic template completed without checking the design, ownership and notice type may miss an important requirement.

Identify the relevant owners

Who receives the notice and how is it served?

Notice must reach the relevant adjoining owners. There may be several owners of a single property, including a freeholder and a qualifying leaseholder. The occupier or person answering the door is not necessarily the only person who needs notice.

The Act permits particular methods of service. Email should only be used where the recipient has agreed to receive notices electronically and has provided the relevant address. Keep a copy of the notice, accompanying documents and evidence of service.

We can help identify the required recipients and appropriate service arrangements. Tell us about flats, company ownership or difficulties obtaining owner details when you first contact us.

Consent, dissent and silence

What happens after a notice is served?

For party structure and adjacent excavation notices, written consent within the relevant response period can allow the matter to proceed without an award, subject to the notice period and other applicable requirements. Dissent, or no written consent within 14 days, brings the statutory dispute procedure into play.

The owners can agree to one surveyor or appoint separate surveyors, who select a third surveyor. Every appointed surveyor must act impartially, whichever owner appointed them.

New-wall notices require care: a wall astride the boundary needs the adjoining owner’s written consent. An award cannot force that consent. Without it, the building owner may instead have rights to build wholly on their own land, subject to the Act and other rights. See adjoining-owner advice.

A useful baseline

Should a Schedule of Condition be prepared?

A written and photographic record of the relevant neighbouring areas is often sensible before work begins, including where the owner consents. It helps the parties compare later observations with the condition recorded before work.

A schedule is separate from consent or an award. It is not a guarantee against damage or proof of what caused every later defect. Coverage and access should reflect the proposed works. Read about a party wall Schedule of Condition.

Advice matched to your project

How can Harding help, and what does it cost?

  1. Share the design

Send the address, drawings, work details and intended programme.

  2. Confirm the route

We identify the service needed, the information required and the relevant notices.

  3. Agree the scope

Your quotation sets out the fee, applicable VAT, inclusions and expected timing.

  4. Review the response

Further surveyor appointments, a schedule or an award are addressed as required.

Fees depend on the work, ownership arrangements, number of recipients and any further procedure. We quote for your circumstances rather than assuming notice preparation covers every later stage. If works have started without notice, tell us immediately so we can discuss the appropriate advice.

Good overall experience.
I contacted Handing Chartered Surveyors to undertake a Level 2 RICS survey for a help to buy redemption in Southall, following issues with the paperwork produced by a large online competitor, resulting in the original valuation document being rejected. On contacting Harding I set out my needs along with the issues faced previously, and Harding were very quick to respond, as well as to confirm they were happy to be flexible if there were issues with the process after the valuation report was produced. Jessica from the team visited and undertook the survey following a discussion about my specific situation and needs, as well as discussing the process and next steps. She was kind, courteous and communicative throughout, calling to discuss the valuation prior to it being finalised and issued. Help to Buy subsequently accepted the valuation with no issues at all, a success! While it is sometimes cheaper and quicker to go with a large provider, it is also very difficult to discuss case specifics, and to address any challenges. I am personally very grateful for the service I received, a strong reminder to go local to get what you need, and I will very happily employ Harding again for any future survey needs.
Harding Surveyors are very prompt, professional and helpful. Their reports are detailed and very clear. They have saved me from major property headaches that I couldn’t see myself.
Excellent ! Very professional. The report was produced quickly. Charlie, the surveyor, was excellent. I have no hesitation in recommending Harding.
Very straighforward process, excellent support from staff
Alaa came when Hardings said he would, looked at everything, explained as he was going along, explained what he thought the issues were as he surveyed, took time to talk to our neighbour who is also affected by the subsidence, sent report when promised and then has been very available to explain what might happen next and why. Great service.
Extremely professional service. Easy to contact and to establish a good rapport. The final report was extraordinary in detail
Very happy with the service provided. Arrangements were promptly made to access the property to undertake the valuation, after which the report was sent several days later. The report is comprehensive and is of a high professional standard. Overall very pleased with the service. I will return again should I need any more help in the future.
Delivered ahead of time and in agreed scope.
Good service, the initial deadline was missed but the quality of work is good.
I have used Harding Chartered Surveyors three times in the last 2 years to carry out valuations of properties. I found them to be efficient and good value. Kate always got back to me quickly and I was also able to communicate directly with the surveyor. Their final reports were polished and professional. I can recommend.
Extremely professional and personal service. I commissioned two reports recently, one for a structural engineering inspection and one for a full level three report. Both reports gave me what I required and more. I would highly recommend.

Your questions answered

Your questions answered

Can I prepare a Party Wall Notice myself?

A building owner can prepare and serve a notice. It must use the correct route, include the required information and be served on the relevant owners. Professional checking can help where ownership or the design is complicated.

Is the notice period always two months?

No. A party structure notice generally requires two months. New boundary wall and qualifying adjacent excavation notices generally require one month. A project can involve several notice types.

Can work start as soon as my neighbour consents?

Do not assume so. The relevant minimum notice period is separate from the response deadline. An earlier start needs the appropriate agreement, and other permissions or requirements may still apply.

What happens if my neighbour does not reply?

For party structure and adjacent excavation notices, no written consent within 14 days generally triggers the statutory dispute procedure. New walls astride the boundary have different consent rules. Seek advice on the notice actually served.

Can a notice be emailed?

Electronic service requires the recipient’s agreement to receive notices that way and the relevant email address. Keep the consent and evidence of service. Other statutory service methods may be more appropriate.

Is planning permission needed before serving notice?

The party wall procedure is separate from planning permission and building regulations. You can discuss notices while other approvals are being arranged, but the design and required notice details must be sufficiently clear.
